Who Says So, Website Terms of Use
Welcome to Who Says So. By accessing or using this website or the service, you agree to be bound by these Terms of Use. If you do not agree with these terms, please stop using the website.
In these terms, "we", "our" or "us" refer to Avtext Pty Ltd trading as Who Says So (ABN 88 116 839 037). "You" refers to any person who accesses or uses the website or the service, whether to build a report, to read one, or as a visitor.
1. Acceptance of terms
By using this website you acknowledge that you have read, understood and agreed to these Terms of Use and to our Privacy Policy. If you use the service on behalf of a business, you confirm you are authorised to accept these terms for that business.
We may update these terms from time to time. Where a change materially affects your rights, we will give you reasonable notice before it takes effect, and your continued use of the website after that date means you accept the updated terms.
2. YouTube's terms apply too
Who Says So uses YouTube API Services. By using Who Says So you agree to be bound by the YouTube Terms of Service as well as these terms. Google's handling of data is described in the Google Privacy Policy.
3. What Who Says So is, and is not
Who Says So is a comment research service. You give us a keyword. Using your own YouTube API key, your browser fetches the public comments on the most-viewed videos YouTube returns for it. We read every comment with a language model, classify it by kind, find the topics people raise and count which way each leans, and give you a report and a downloadable file.
You agree and understand that:
- A report is research: counts of what the people who commented said, in their own words. It is not a poll, not a survey of the public, and not a recommendation.
- The kinds, topics, leans, counts and percentages on a report are our own classifications, not YouTube data, and YouTube has not reviewed or approved them.
- Comment text, video titles, descriptions and statistics come from the YouTube Data API on your key, read once when the report is run, and are true as at that moment.
- We are not affiliated with or endorsed by YouTube or Google.
4. Your Google account and your API key
You sign in with Google so the service knows who you are. We ask Google for your name and email address and nothing else, and we never ask for access to your YouTube account.
The service runs on a YouTube API key that you create in your own Google Cloud project. You are responsible for that project, for keeping the key confidential, and for its use of YouTube API Services under Google's terms. The key stays in your browser; we never see it, and every call to YouTube goes from your browser on your key. The daily quota Google gives your project is yours, and a search that exhausts it is a matter between you and Google.
5. Reports and your content
The keyword, the exclusions and the expectations you type are yours. We use them to run your search and to write your report, and for nothing else. Our server does not log searches.
The report and the file are yours to use for your own research, inside your business or for your own decisions, including with an AI assistant of your choice. The comment text in them is public YouTube content and remains subject to YouTube's terms: you must not republish it as a dataset, sell it, or use it to identify, contact or target the people who wrote it. Our classifications, counts and percentages are our work; you may quote them with attribution to Who Says So.
A report is a page at an address only you are given. Anyone you give that address to can open the report. Every report in your saved list has a Delete control, and deleting a report removes it and its data from our server at once.
6. No guarantee about results
To the maximum extent permitted by law, we do not guarantee anything about what a search will find or what a report will show. In particular:
- A language model reads each comment, and any single comment can be misread. Treat a percentage as a measurement with that error in it, and open the comments behind any figure you rely on; every row links to the comment on YouTube.
- A report describes the people who commented on those videos in that window. It does not describe the public, your market, or your customers as a whole.
- We do not guarantee that a search finds every relevant video, that a topic that is absent from the comments is absent from the market, or that YouTube API Services will always be available or unchanged.
- Nothing on the website or in a report is financial, legal, marketing or professional advice. Decisions you make from a report are yours.
7. Prohibited conduct
You must not:
- use the website or a report for any unlawful, fraudulent or misleading purpose;
- use the service to breach the YouTube Terms of Service or Google's policies;
- use a report or its file to harass, profile, identify or target the people whose comments appear in it;
- harvest, scrape, copy or extract data or content from the website by automated means, build a dataset from the comment text, or reproduce or resell any part of the website or its content;
- attempt to bypass, disable or interfere with the website, its security, its quotas or its fee arrangements; or
- upload harmful code or attempt to gain unauthorised access to the website or its systems.
8. Fees and payment
Each report has one price, set by how many comments the report reads. All prices are in Australian dollars and inclusive of GST. The price for your report is shown on the website before you commit, and we will issue a tax invoice for each payment.
- Pay per report. There is no subscription and nothing recurs. Each report is a one-off charge.
- Billing. Payment is charged to the payment method you provide through our payment processor, Stripe. The charge is completed only when your report has been built. If the run fails before a report exists, the hold on your card is released and you pay nothing.
- Prices may change. Our prices are current at the date shown but may change over time. The price that applies to a report is the price shown when you confirm it.
9. Refunds
A report is a service we perform for you and deliver at once, so a completed report is not refundable once it has been built, unless the law requires it or the report is not what these terms describe, in which case write to us. Nothing in this section limits your rights under the Australian Consumer Law (see section 11).
10. Information on the website
The website includes example reports and example figures. Where a figure is marked as an example, it is invented to show the shape of a report and describes nothing real. The demonstration reports open to anyone are real searches run on our own key and are refreshed periodically; the comment text in them is removed after 30 days, as YouTube's terms require.
11. Consumer guarantees and limitation of liability
Our services come with guarantees that cannot be excluded under the Australian Consumer Law. Nothing in these terms excludes, restricts or modifies any right or remedy, or any guarantee, warranty or other term or condition, that the law says cannot be excluded or limited.
To the maximum extent permitted by law, and subject to those non-excludable rights:
- the website and the service are provided "as is" and "as available", and we do not warrant that they will be uninterrupted or error-free, or that any classification or figure is accurate;
- we exclude all liability for any loss or damage (including indirect or consequential loss, loss of profit and loss of opportunity) arising from your use of, or reliance on, the website or a report; and
- where we are liable for a failure to comply with a consumer guarantee that cannot be excluded, and the failure does not relate to goods of a kind ordinarily acquired for personal use, our liability is limited, at our option, to supplying the report again or paying the cost of having it supplied again.
12. Privacy
We handle personal information in accordance with our Privacy Policy, which forms part of your use of the website. By using the website you agree to the collection and handling of your information as set out in that policy.
13. Intellectual property
The website, the service and all content we provide (including text, branding, graphics, layout, design, and our classifications and counts) are owned by or licensed to us. You must not copy, reproduce, modify, distribute or extract any part of it without our written permission, beyond the use of your own reports allowed in section 5. Comments, videos, titles and thumbnails on YouTube belong to their respective owners. YouTube and the YouTube logo are trademarks of Google LLC.
14. Third-party links and services
The website links to external sites, including YouTube, and the service relies on Google, Stripe and OpenAI to sign you in, take payment and classify comments. Links are provided for convenience only. We do not control those sites or services and take no responsibility for their content or practices.
15. Indemnity
To the maximum extent permitted by law, you indemnify us against any claim, loss, liability or cost (including legal costs) we suffer or incur arising from your use of the website or a report, your use of your Google Cloud project or API key, your breach of these terms, of the YouTube Terms of Service, or of any law.
16. Suspension and termination
We may refuse or stop service to you, or remove a report, at any time if you breach these terms, if we are required to by law, or if we reasonably believe your use poses a risk to other users, to us, or to our standing with Google. You may stop using the website at any time. Sections that by their nature should survive (including sections 5, 6, 11, 13 and 15) continue after your use ends.
17. General
- Governing law. These terms are governed by the laws of New South Wales, Australia, and you submit to the courts of New South Wales.
- Severability. If any part of these terms is found to be invalid or unenforceable, the rest continues to apply.
- Assignment. You may not transfer your rights under these terms without our consent. We may assign or transfer our rights, for example if our business is sold.
- Waiver. If we do not enforce a right, that is not a waiver of it.
- Entire agreement. These terms, together with our Privacy Policy, are the entire agreement between you and us about your use of the website.
